Waikato District Plan – Operative in Part

Waikato District Council has published an annotated version dated 30 October 2024 called the “Waikato District Plan - Operative in Part”. The Waikato District Plan - Operative in Part identifies which provisions are operative, and those provisions that are the subject of appeals which are still being progressed.

Where a provision is identified as being subject to appeal, this has been determined from the notices of appeal filed in 2022 as well as potential consequential amendments identified from either the notices of appal or through direct discussions with the parties involved. The appeals and any consequential amendments are continually changing as appeals are being progressed, so this is a ‘living’ document.  Updates to the Waikato District Plan - Operative in Part will be published at regular intervals on this website, and any future updates will be dated accordingly.

Waikato District Council has taken reasonable care to accurately identify the provisions that remain subject to appeal based on the information available at the relevant time. Waikato District Council is not  liable for any claims, misrepresentation, incompleteness,  inaccuracies or losses incurred as a result of identifying associated with the annotation of provisions as being potentially subject to appeal. It is the responsibility of Plan users to identify whether the provisions they rely on are subject to appeal.  those provisions which can be deemed operative under section 86F of the Resource Management Act.

The table shows each appeal and the amendments that have been made to reflect the resolved or withdrawn appeal. There is a link to each consent order for ease of reference to each appeal. Please note there are no consent orders with withdrawn appeals.
